DISCLAIMER AND ASSUME OF RISK

By accepting this document, I acknowledge that participating in the lesson, rental and use of eFoil, eSup, Sup, Kayak, Seabob, eScooter is a potentially dangerous activity. The activity involves risks, including serious injury and/or death.

• I am aware that, although E-WAVE – SEASTAR S.R.L. (hereafter referred to as the “Operator”) has taken all reasonable precautions to provide seaworthy equipment and associated rental equipment, as well as an experienced and well-trained instructor, and has made arrangements for my safety as a passenger/surfer, you impossible for the Operator or its contractors to ensure my safety before, during or after the lesson and use of the sports equipment.
• Therefore, I hereby waive all claims for damages against the Operator and its agents, heirs, representatives, employees and contractors arising out of my participation in the training and use of the equipment and related activities offered by the Operator or its contractors.
• I further acknowledge that as of the date of my signature below, I have voluntarily requested and agreed to participate in the instruction and use of such equipment and related activities offered and conducted by the operator or an operator’s contractor.
• I understand that using the equipment is a potentially dangerous activity. Use can cause serious bodily injury or death. Risks and dangers include, but are not limited to, loss or damage to personal property, violation of the law, injury or death resulting from training and use of equipment, including surfboard overturning electricity, colliding with obstacles, accidents or illnesses in remote places without medical facilities, hypothermia and drowning.
• I participate voluntarily and with full awareness of the risks and dangers connected, in the lesson and use of the aforementioned equipment and related activities and I hereby accept and assume all risks of damage, injury or death and I acknowledge it by signing below or accepting these terms and conditions online or on paper.
• I am aware that I am responsible for my own safety and that of others, and I accept this responsibility. I agree to follow the instructions of the operator and its contractors before and during instruction and operation of the equipment. I acknowledge and agree to abide by the operator safety guidelines listed below.
• Safety Guidelines: The safety of passengers/passengers is the first and foremost concern of the operator. The operator or its contractors decide based on a number of factors. Some of these factors include: Weather, atmospheric and other conditions prior to and during preparation for instruction and operation of said sports equipment. All decisions regarding safety, whether and how long to train and use the equipment, are at the sole discretion of the operator or its contractor.
• I declare that I have no physical or mental problems that would prevent me from participating safely in the instruction and operation of the sports equipment.

I declare that I have read this Declaration and Release carefully and that I fully understand its contents. I understand that the Operator and its contractors cannot guarantee my safety during the instruction and operation of the sports equipment and related activities and that this is a disclaimer and evidence of a contract between me and the Operator or the its contractors, and that I perform them voluntarily and of my own free will in exchange for the instruction and operation of the equipment provided to me as a passenger/student.
